Dear President Donald J. Trump, 

We, the citizens of Pennsylvania, urge you to END/REPEAL the Obama mandate known as Executive Order - 13508 Chesapeake Bay Protection and Restoration and the MS4 Program (Municipal Separate Storm Sewer Systems (MS4s)).  

The MS4’s birth was under the Federal Clean Water Act of 2002, when DEP issued a General Permit (“PAG-13”) for use by MS4s that fall under the National Pollutant Discharge Elimination System (NPDES) Phase II program, requiring the implementation of a storm water management program for minimizing the impacts from runoff.

We are weighted by a LARGE *“Rain Tax” of the above Executive Order 13508 and MS4 Permit. This unfair and unfunded mandate was pushed from the local municipalities to the individual taxpayer directly through high priced contracted entities taking advantage of Pennsylvania residents. 

In 2016, the people of Pennsylvania strongly voted for you, Mr. President. Now we need you in 2020 to put an end to Executive Order 13508 and the MS4 Program. We are waiting for you to address this, as it is the most important issue in Pennsylvania. 

We have lost more than any gain there would have been from your Financial and Economic Recovery Plan because of this burden. The 32 municipalities in Luzerne County alone are shelling out $8.5 million dollars annually (not including grants and other funding) to no end and with no real results. Hardworking blue-collared Americans, the retired and elderly are being “taxed” out of their homes.  Your citizens are in desperate need of your attention to this matter. 

The economic depression caused by this “RAIN TAX,” disguised as storm water fees, is crippling your voters of Pennsylvania. The trickle down from this “tax” has each taxpayer paying for our properties, our church properties, nonprofits, commercial, local and county government properties, fire departments, school properties and so on. EVERY property is taxed with this fee. Which means each taxpayer pays this fee repeatedly. They calculate how much rain comes off your roof, driveway, etc. at a ridiculous and unreasonable rate with no real science or positive outcome. All Pennsylvanian eyes are watching to see who is willing to give us the much-needed relief, by ending Executive Order 13508 and the MS4. It is an unfunded mandate in violation of the Unfunded Mandate Reform Act of 1995.

In short, we humbly beg you to END THE RAIN TAX known as Executive Order 13508 - Chesapeake Bay Protection and Restoration and END the MS4 Permits.

End the rain tax

The first endeavor is End the Rain Tax. We have been working hard behind the scenes to move forward in our fight against this unfair “tax”. We are and have been continually working to get the word about this issue to our government leaders.



Accomplishments


 Led initiative challenging initial WVSA fee structure. Obtained substantial reduction in all fees across the Wyoming Valley.

                     By our calculations, we achieved a 40% reduction in assessed storm water fees which saved taxpayers $5,600,000. 

         

 

Pressured Lehman Township into seeking a waiver. Lehman's approved waiver relieved township   residents from the storm water burden for 5 years.

 

         

United community in outreach meetings. Educates the community through WILK radio and community events.

         

 

Established "End the Rain Tax" community awareness campaign.

         

Met with legislative representatives in and outside of the Wyoming Valley.

         

 

DEP and EPA distance themselves from WVSA extreme approach. 

 Informational letters sent from EPA.

        

Establish a strong legal battle to eliminate storm water fees and relieve the community of this multi-million dollar   economic burden.

 

Fundraise through tax deductible contributions.

         

Challenge legislative representatives to remove the fee and hold WVSA  accountable for the funds received. What new services have been provided?

 

Was it necessary for our community to pay $8,400,000 to have storm water basins cleared?

         


Future Goals: 


 Engage and educate the community.

 

Gain support through additional volunteers and fundraising.

         

 

Require full audit of authorities.

         

 

Determine the effectiveness of assertions presented.

 

Was there a reduction in pollution identified?

 

How are projects determined?


Require an equitable approach to fees across PA and watershed.

· Help with the costs, without funds we cannot continue this fight. Monetary gifts are needed.
